DescriptionDiscussion: This section requires the EIR to describe the proposed
project in a way that will be meaningful to the public, to the other reviewing
agencies, and to the decision-makers. Although the statute contains no express
requirement for an EIR to contain a project description, the statutory points
of analysis need to be supplemented with a project description for the analysis
to make sense. This section is a codification of the ruling in County of Inyo v. City of Los Angeles,
cited in the note. There the court noted that an accurate description of the
project has been required by case law interpreting the National Environmental
Policy Act. The state court of appeal declared that an accurate, stable, finite
project description is an essential element of an informative and legally
sufficient EIR under CEQA.
